Аннотация
Лекции по естественному праву, читавшиеся Кантом в зимнем семестре 1784/85 года, в последнее время привлекают к себе все больший интерес кантоведов, так как благодаря тому, что они относятся к середине 80-х годов XVIII века, с их помощью удается прояснить ряд крайне важных моментов генезиса кантовской практической философии. В первую очередь это относится к становлению взглядов кёнигсбергского философа на вопросы права. Но не менее важны записи данных лекций (особенно введение) и для прояснения некоторых проблем кантовской этической концепции, а также того, как Кант видел взаимосвязь и взаимодействие этики и права. И здесь немаловажную роль играет трудно переводимое на русский язык понятие Billigkeit, встречающееся и в других текстах Канта по практической философии. Чаще всего данное понятие переводится на русский язык как «справедливость». Однако в немецком языке имеется другое слово — Gerechtigkeit — полностью соответствующее русскому «справедливость», что само по себе уже делает данный вариант перевода не совсем удачным. Кроме того, перевод Billigkeit как справедливость создает ложные коннотации данного понятия с правовой сферой, чего как раз и пытается избежать Кант, указывая на существенные различия между понятиями Billigkeit и Gerechtigkeit. Если в сфере ведения Gerechtigkeit оказываются внешние поступки, поддающиеся правовому регулированию и внешнему принуждению, то Billigkeit относится только к сфере неявленных намерений или умонастроений, которые никак не могут контролироваться извне. На этом важном отличии Кант и обосновывает во введении к «Лекциям по естественному праву» свой тезис о нетождественности этики и права и о необходимости тщательнее определить место естественного права в системе практической философии.
Abstract
The lectures on natural law delivered by Kant in the winter semester of 1784/85 have recently attracted increasing attention from Kant scholars. Dating back to the 1780s, they elucidate a number of important aspects in the genesis of Kant’s practical philosophy. Firstly, this relates to the formation of the Königsberg philosopher’s views on law. However, the lecture notes (especially the introduction) are of equal importance to understanding certain problems of Kant’s ethical concept and interpretation of the connection between ethics and law. An important role is played by the concept of Billigkeit, which is rather difficult to translate into the Russian language and is found in other Kant’s texts on practical philosophy. This term is usually translated as justice. However, there is another word in the German language — Gerechtihkeit — that has the meaning of justice. Moreover, such translation of Billigkeit creates a false connection with the realm of law, which Kant tried to avoid stressing the difference between Billigkeit and Gerechtigkeit. If Gerechtigkeit relates to external deeds subject to legal regulation and external enforcement, Billigkeit relates to tacit intentions and dispositions that cannot be controlled from the outside. This supports the thesis about the difference between ethics and law and the need for a more accurate identification of the place of natural law in the system of practical philosophy.
