Аннотация
Статья посвящена попыткам многих либертарианских философов обосновать принцип самопринадлежности с помощью второй формулировки категорического императива. Сначала в статье реконструируется сам принцип самопринадлежности, согласно которому каждый человек обладает естественным правом собственности на свое тело и личность. Существует множество версий этого принципа, которые признают разные наборы таких имущественных прав, но общая черта всех формулировок — их радикальный антипатернализм и, как следствие, признание допустимости саморазрушительного поведения. Затем реконструируются и анализируются два кантианских аргумента в защиту самопринадлежности. Согласно первому, люди обладают внутренней ценностью, а потому никогда не должны использоваться просто как инструменты для чужих целей, что запрещает владение другими людьми. Согласно второму, людям необходимо владеть своим телом и личностью для реализации личной и моральной автономии, которые нужны для исполнения морального закона. После этого описываются два способа, которыми самопринадлежность может сочетаться с различными теориями тождества личности: интернализм и экстернализм. Интернализм предполагает, что тело либо тождественно личности, либо является ее частью. Экстернализм предполагает, что тело является чем-то внешним по отношению к личности, которая представляет собой нефизическую ментальную субстанцию. Эти два подхода сталкивают кантианских либертарианцев с дилеммой. Если они принимают интернализм, то самопринадлежность несовместима с категорическим императивом, потому что предполагает самоинструментализацию. Но поскольку все люди обладают равной ценностью, инструментализация самого себя так же недопустима, как инструментализация других людей. Если же кантианские либертарианцы принимают экстернализм, то самопринадлежность просто не следует из категорического императива, потому что нарушение прав собственности на внешние ресурсы не является инструментализацией их собственника само по себе. Таким образом, категорический императив и самопринадлежность несовместимы.
