Magistrates’ and volost courts of the Russian Empire on their way to amalgamation
AbstractHistorically, the magistrates’ court — being a public institute in its nature — has co-existed with community (communal) authorities, including judiciary institutions. As a result, under certain conditions, community courts are subject to the magistrates’ court or even included in its structure, absorbed by it. This article investigates the background and course of this process in the history of the Russian Empire of the 19th/early 20th centuries. The author explains how volost courts gradually became part of the Justice of the Peace.
