The Kantian Concept of Human Dignity Today
... material benefits, in its legal sense — above all in the 1993 Constitution of the Russian Federation — anti-communist ideology has turned it into the “right” to enjoy comfortable living conditions, being almost totally divorced from duties and from morality. Such interpretations of human dignity lead to a dead end, creating problems for its perception and for its relationship to other constitutional provisions — problems that are impossible to resolve in the framework of such an interpretation ...
Deduction of Freedom vs Deduction of Experience in Kant’s Metaphysics
... opposite directions. Theoretical deduction proceeds from pure forms of sensible intuition to concepts of understanding and thence to fundamental principles. Practical deduction proceeds from a priori principles to the concepts of the metaphysics of morals and thence to moral feelings. Fourth, deduction in the theoretical sphere forbids speculative reason to go beyond experience. Practical deduction has pointed to the intelligible world and has proved its “legitimacy”.

Affection of Law: Fichte on the Place and Boundaries of Pure Ethics of the Imperative
... law of the Stoical and Kantian type. Fichte stresses that in his youth he himself shared this worldview. However, he hastens to adduce a series of original arguments to show that this position is essentially incapable of delivering a pure and higher moral doctrine. I examine the substance of these critical arguments in the context of his later metaphysics. Fichte maintains that in the “second type” of worldview man himself feels and understands, respects and loves himself only as a subject of ...
The notion of anthropology in Kant's philosophy

Does anthropology aim to answer the question about the vocation of a human being? To what extent is metaphilosophy present in the Anthropology? What is ...
How transcendental are Kant’s principles of public law?
... found in Kant’s later writings. Finally, the author considers a moderate interpretation that makes it possible to harmonise the publicity principles as (meta) principles of lawmaking and law enforcement with the core of Kant’s system of law and morals. This resolves the issue of direct efficiency of these principles, whereas the declaration of the formal character of the ‘doctrine of happiness’ dispels doubts over the implicitly a posterior and empirical nature of criteria introduced as ...
A Relation to the Politikal Revolution as a Touchstone for Practical Philosophy
... achieve a ‘true reform in ways of thinking’ and that cruel political revolutions can liberate the society from such oppression. The paper explains Kant’s positive attitude to the French revolution as a ‘historical sign’ of the possibility of moral and legal improvement of humanity through striving for moral goals. Political revolutions are considered as the initial (‘negative’) stage of enlightenment consisting in the liberation from coercion and ‘assistance’ from guardians. This ...
The communication of persons: Kant’s theory of marriage law held captive by pagan anthropology
... additional arguments for a reform of Kantian philosophy of matrimonial law. In the expositions of Kant’s philosophy of marriage, when purified from this naturalistic premise, there can be traced some more integral notion of family union, seen as a moral unity of persons as such, in regard to which the marriage as external union of physical persons is a mere consequence and legal form. The personal union in matrimonial communication creates a relation in which there are two physical persons, but ...
The axiological discourse in A. Veltman’s poem The Woods of Murom
... development of the theme of robbers’ life, which was introduced by Pushkin and became central to Russian Romanticism. An analysis of the poem in the axiological aspect shows that A. Veltman – as well as other Russian poets – is interested in the moral and psychological reasons behind this phenomenon rather than social ones. The plot structure and the author’s position suggest that robbery is depicted in the poem as a cardinal sin that cannot be justified; it forces a person to abandon the moral ...
The motive of duality in the novel “Cursed Place” by M.I. Voskresensky
... female twin-images, who look similar, but differ in nature. Duality plays a significant role in novel’s plot, it reveals characters’ personalities. At the same time duality of female images becomes a moment of their testing, examination of their morality and feelings. Male images (Linsky and Lonsky) do not pass this test, female ones (Claudia and Masha), thanks to duality, discover the true values of life, which are not in love for a man and not in wealth, but in following a sense of duty to ...

Convergence of legal thinking from the perspective of the uncertainty principle
... a transdisciplinary approach, i. e. extrapolating methodologies from across disciplines to the theory of law. We propose to extrapolate to jurisprudence the principles of uncertainty, which implies that a legal rule cannot deal with both elements of moral law and rules of conduct. I conclude that developing a single framework for the understanding of law by converging methodologies from across disciplines will help to identify new facets of law.

Christian Wolff and Immanuel Kant on the Existence of God
... pre-critical and critical periods. The author looks at the role God plays in Kant’s practical philosophy. Comparing the positions of Kant and Wolff, the author finds many similarities between them. Chief of them is that although both thinkers saw the moral/natural law as universal and obligating regardless of a person’s faith in God, in fact faith in God turned out to be an inevitable consequence of the true moral attitude of the individual.

The ethical and philosophical antinomy of foundations of Kant’s theory of family law
The present paper focuses on the ethical and anthropological foundations of Kant’s philosophy of family law conceived as a “personal right that is real in kind”: the possibility of possessing a person as a property item presets the antinomy of moral and legal principles, which reproduces the conflict between Roman naturalistic legal theory and the contractual philosophy of natural law. The author also considers the ways to overcome this antinomy, as well as ensuing solutions to the problems ...
