Международно-правовое регулирование статуса добровольных живых щитов

Аннотация

На основе анализа действующих норм международного гуманитарного права, регулирующих случаи использования сторонами вооруженного конфликта живых щитов, обосновывается вывод о том, что эти лица представляют собой случай sui generis и должны быть исключением из ряда общих правил. Таким образом, добровольные живые щиты не могут рассматриваться как принимающие непосредственное участие в военных действиях и к ним должен применяться принцип пропорциональности, с той лишь оговорокой, что планка оценки чрезмерности косвенного ущерба может быть несколько снижена.
