Heritage aspect of personal insurance

Abstract

The relevance of the presented study lies in the active process of reform­ing domestic civil legislation, and in particular, the rules of insurance. A number of proposals for changing the current legal regulation, formulated in the Concept for the Development of the Provisions of Part Two of the Civil Code of the Russian Federation on Insurance Contracts, naturally need a thorough doctrinal assessment. Such proposals also include the hereditary as­pect of personal insurance highlighted in the Concept (paragraph 1, clause 2, article 934 of the Civil Code of the Russian Federation). The purpose of the study is to interpret, given the provisions of the doctrine of civil law, foreign legislation and law enforcement experience, the provisions of paragraph 1 of paragraph 2 of Article 934 of the Civil Code of the Russian Federation, which establishes the right of the heir of the insured person to receive insurance payment after his death. Conclusions. The term "heir" used in Article 934 of the Civil Code of the Russian Federation should be determined based on the provisions of Section V of the Civil Code of the Russian Federation only in a subsidiary manner, which rejects the possibility of including insurance pay­ment in the estate of the insured testator. Welcoming the general vector of the Concept and the positive potential of the changes proposed by it, it seems that with the support of the interpretation proposed in the framework of the study and its consolidation at the level of acts of the highest court, there is no need to make appropriate changes to Article 934 of the Civil Code of the Russian Fe­deration.

A five-year way from the first departmental forensic medical examination to the systematic state forensic expert activity

Abstract

The article considers the main milestones of the formation and develop­ment of forensic medical expert activity in the structure of the Investigative Committee of the Russian Federation. Following a series of articles, the cur­rent one highlights the most significant cases of individual investigative ac­tions with the participation of a specialist in the field of forensic medicine. The five-year practice has been re-examined: from the first forensic medical exami­nation in 2015 to the establishment of state forensic institutions of the Inves­tigative Committee of the Russian Federation.

The best interests of the child in the context of criminal procedure policy

Abstract

The novelties of the Criminal Procedure Law of the Republic of Belarus show the commitment to introduce child-friendly technologies in practice. However, studies show the lack of consistency in the identification of Criminal Procedure policy for minors. Reforming the legal status of minors in criminal proceedings could be more effective in the case of a system-forming basis.

The international legal principle of the best interests of the child could be the foundation of the criminal procedure policy for minors, ensure the system­atic development of the Criminal Procedure Law, and contribute to combating crime. The study of implementing the principle requires the application of sys­tematic, comparative legal analysis and formal-legal methods.

As a result, it is possible to determine the features of the criminal proce­dural policy for minors, taking into account the principle, as well as ways for further improvement of legislation. Nonetheless, the issue of legal recognition of the principle is debatable.

Identification of the Couple’s Portrait from the Tansey Miniatures Foundation: identification issues

Abstract

This article examines a couple’s miniature portrait, traditionally ascribed to Italian artist Julie Corneo, kept in the collection of the Tansey Miniatures Foundation. Relying on the printed and archival sources, the author was able to establish the identity of the general and his wife shown on the miniature. More importantly, the author attempted to re-examine the evolution of the uniforms of generals of the French Republic between 1791 and 1803 and to demonstrate the function of regulations and normative documents of this pe­riod. The process of identifying these portraits, through complex analysis and comparative approach, offered an opportunity to cast a fresh look at the exist­ing tangible culture and to bring to light one of the mechanisms of construct­ing the identity of the French nation, its symbols and national language.

The schism of Abolitionist movement in the USA and Wendell Phillips's struggle in the Reconstruction era

Abstract

This article focuses on one of the main persons of the abolition movement, Wendell Phillips. The author studies Phillips' role in abolition struggle du­ring the Reconstruction. The author describes Phillips' position the schism in the abolitionist movement in 1865. The author characterizes Phillips' position in the internal struggle with W. L. Garrison. The author examines Phillips' argument in favor of preserving the abolitionist organization for the introduc­tion of the black issue as central in the process of restoring the unity of the Union. The author expounds Phillips' reconstruction program and his strug­gle as a leader of the movement from 1865 to 1870.

On the development of a western worldview in the context of the journal “Vestnik Evropy” in the correspondence between Alexey Veselovsky and Alexander Pypin

Abstract

This article examines an extensive collection of 46 letters sent by Alexey N. Veselovsky to Alexander N. Pypin (found in IRL RAS (Saint Petersburg)) and 47 letters of Alexander N. Pypin to Alexey N. Veselovsky (found in RSL (Moscow)). The epistolary heritage of the famous Moscow literary critic Ale­xey N. Veselovsky has not yet been studied. Using the materials of his episto­lary exchange with the literary historian and academician Alexander N. Pypin we have outlined this scientific and literary circle of philologists along with their personal and business relationships, better defined their input in popularizing the ideas of Westernism at the end of the 19th century, and also de­scribed their journalistic activities during the period of cooperation with a lib­eral journal “Herald of Europe”. The author believes that Pypin's ideas in­fluenced development of Veselovsky as a scientist. This correspondence ap­pears to be highly valuable both as an important record of Alexey Veselovsky's autobi­og­raphy and the whole epoch of the end of the 19th — the early 20th cen­tury.

Politics of urban identity in the cultural heritage discourse of St. Petersburg: media analysi

Abstract

The article is devoted to the urban identity construction within the exist­ing, inhomogeneous, conflicting discourse of the cultural heritage of St. Pe­tersburg. The discursive practices of the actors of 7 discourses within the main discourse of the cultural heritage of St. Petersburg are reconstructed from the media and field studies; 9 dispositive variables of each discourse are consi­dered.

Narrative and other discursive strategies are systematized according to their role in the reassembly of the system (network). While each actor pursues their own goal and solves several problems, the overall configuration of the system determines the characteristics of the reassembly carried out.

The articulation of interests, goals and values ​​of actors leads to a clearer distribution in a theoretical perspective, authentic identification and a con­scious choice of practices and policies in the construction of urban identity.

The CPSU and the CPC: comparative aspects of the historical and cultural approach

Abstract

The comparison of the ideas and activities of the CPC and the party that formally ended its activities in Russia under the name of the CPSU is relevant for analyzing the prospects of the socialist, communist way of development. At the same time, in our opinion, it is important to consider the cultural, his­torical, and cultural aspects of such a comparison. The methodology of the re­search is connected in this case precisely to the historical description of the main stages of development, the nature of the activities of the communist par­ty in Russia and in China with the historical and culturological assessment of known facts. The conclusions of the article are related to the more European nature of the Russian mentality, more dynamically contrasting, difficult events in the history of Russia as a serious factor in the formation and work of the CPSU (in particular, this explains the factional movement, multiparty system as a condition for functioning, the rigidity of politics, etc.); at the same time, the desire of the Chinese for harmony, the philosophic nature of their thinking, greater traditionalism cause a smaller number of factions in the CPC, possibly "soft" cooperation with other parties (with a small number of the latter), etc. The flexibility of Chinese thinking in a very traditional coun­try is surprising by the very fact of the "unexpected" and effective, in fact, re­placing the government of the party movement at a certain historical moment. Even though in Russia, too, the "open" democratic process in the early XX cen­tury appeared as if "from scratch", it, being more European in mentality, had a considerable tradition of political thought of the European type.

The Eric Zemmour phenomenon in French politics

Abstract

The article examines the peculiarities of the worldview and political views of French presidential candidate Eric Zemmour, an extreme right-wing na­tionalist whose popularity came as the main political surprise of the 2022 elec­tion campaign. The article reveals Zemmour's attitude towards the key issues of historical politics and the current French political agenda, such as identity crisis, total nihilism, feminization of politics, his attitude towards Germany, the USA, NATO, the EU, Russia and his views on the Ukrainian issue.
