Ограничительные меры ЕС в отношении России: правовая природа и проблема имплементации

Аннотация
Рассматриваются вопросы, связанные с принятием Европейским союзом в отношении России ограничительных мер. Основная цель статьи состоит в изучении правовой природы санкций ЕС против России, процедуры их имплементации, пересмотра, отмены, а также судебного контроля. Автором проведены систематизация и классификация ограничительных мер в отношении России, анализ действующего законодательства ЕС, регламентирующего введение и имплементацию ограничительных мер, а также судебной практики Европейского союза, связанной с оспариванием актов ЕС о введении санкций. Кроме того, с использованием метода сравнительно-правового исследования проведен анализ ограничительных мер, применяемых Европейским Союзом по отношению к другим странам. В ходе исследования автор предложил следующую классификацию ограничительных мер по отношению к России: индивидуальные санкции; санкции против Крыма и Севастополя; антироссийские экономические санкции. На основе изучения характера ограничительных мер автор приходит к выводу о том, что действующие санкции ЕС в отношении России не соответствуют природе ограничительных мер, поскольку являются скорее наказанием, нежели инструментом проводимой политики. Автор полагает, что в нынешних политических условиях Европейскому союзу будет крайне сложно прийти к единогласию как по вопросу досрочной отмены санкций, так и по вопросу их продления после истечения срока действия. Статья подготовлена по результатам участия автора в международной конференции «Россия — Европа: укрепление доверия», прошедшей 28—29 ноября 2014 г. в Люксембург.
Abstract
The author proposes his take on the EU sanctions against Russia. He aims to understand the legal nature of the EU restrictions, the exact procedure of their implementation, revision, and repeal, as well as their judicial review. To this end, he proposes a system of sanction classification, analyses current EU legislation on the imposition and implementation of sanctions, as well as the case law on the sanction policy. The author also examines EU sanctions imposed on other countries and compares them to the Russian ones. He thus comes up with the following classification of sanctions against Russia: individual sanctions, those targeted at Crimea and Sevastopol, and anti-Russian economic sanctions. He concludes that the EU sanctions against Russia are inconsistent with the legal nature of restrictive measures, since they are a punishment rather than a policy tool. The author believes that in the current political conditions it may be difficult for the European Union to reach a unanimous agreement to repeal or prolong the sanctions. This article is inspired by the discussions that took place during the international conference “Russia and the EU: the Question of Trust” held in Luxembourg on November, 28—29 (2014).
